Synopsis:
Application for leave to appeal concerning the appealability of a decision of the High Court. The Court refused the application for leave to appeal. The Court held that there was no live dispute requiring resolution and that the appeal would have no practical effect on the parties or public at large. Notwithstanding the significance of the Court’s duties and powers in terms of section 172 of the Constitution, it held that, there were no further compelling reasons to grant leave to appeal.
