Synopsis:
Reasons furnished for the earlier order granted on an urgent basis to extend a period of suspension fixed by this Court in Minister of Transport and Another v Mvumvu and Another 2011 (2) SA 473 (CC). In that case, specified parts of the Road Accident Fund Act were declared unconstitutional and Parliament was ordered to cure the defect by 17 August 2012. The Minister applied to extend the period of suspension for a further three months as Parliament was unable to enact remedial legislation within the period. The Court granted an extension of the period of suspension by a further six months because the explanation was sufficient and it was just and equitable to do so. Judgment: Jafta J (unanimous).
