Application for leave to appeal against judgment of Northern Cape High Court - S v Mercer and Another 2003 (6) BCLR 616 (NC). Applicant had previously applied directly to Constitutional Court for relief; Constitutional Court dismissed application and refered matter back to the High Court: Ex Parte Mercer and Another 2003 (1) SA 203 (CC).

Case concerning the constitutionality of the Nature and Environmental Conservation Ordinance. A decision by the Court found it improper to hear this matter until the High Court had heard it. Leave to appeal was dismissed.
