Synopsis:
expired 5 members of the KwaZulu-Natal provincial legislature who crossed were replaced. In a unanimous decision by Chaskalson CJ, the court stressed that there has to be finality in litigation otherwise there would be uncertainty in the lower courts. In addition, the Court's power to vary its own order should be used sparingly. Lastly, the judgment found there to be no ambiguity in its order and therefore no need to clarify.
