Application for leave to appeal directly to the Constitutional Court against a decision of the Witwatersrand High Court.

Application for direct access refused on the grounds that the matter had not yet been heard by the Supreme Court of Appeal. Held that the High Court finding that various provisions of the Extension of Security of Tenure Act 92 of 1997 were unconstitutional was, in fact, obiter and it was not therefore necessary to consider confirmation.
