Appeal against the decision of the High Court in Osman and Another v Attorney-General, Transvaal 1998 (2) BCLR 165 (T) ; 1998 (1) SACR 28 (T), declaring section 36 of the General Law Amendment Act 62 of 1955 constitutionally valid, appeal dismissed.

The right to remain silent and the right not to make a self-incriminating statement. Appeal against the judgment of the Transvaal High Court, challenging the constitutionality of section 36 of the General Law Amendment Act 62 of 1955 on the basis that it is inconsistent with section 25(2)(c) and section 25(3)(c) of the Interim Constitution. Appeal dismissed in unanimous judgment by Madala J.
