Adjudication of a referral to the Constitutional Court by the High Court regarding the constitutionality of s 21(1)(a)(iii) of Act 140 of 1992, relevant section declared unconstitutional.

Section 21(1)(a)(iii) of the Drugs and Drug Trafficking Act which provided that a person found in possession of a dependence producing substance was presumed to be dealing in that substance declared unconstitutional. Presumption of innocence, no rational connection. Maj: Kriegler J (unanimous).
