Synopsis:
Urgent application seeking to appeal an interim decision by the North Gauteng High Court to decline to grant the Applicants an order obliging temporary provision of legal aid at state expense, pending a full review of the State’s obligation to provide legal aid. The Court held that it generally will not hear appeals against interim orders with no final effect, particularly when an interim order concerns the manner in which public resources are spent and has implications on the separation of powers. Leave to appeal was dismissed.
