Synopsis:
Application challenging a costs order granted by the Supreme Court of Appeal. In the High Court the applicant sought to compel the Minister of Safety and Security (Minister) to issue Guidelines for payment of compensation for firearms surrendered to the State in terms of section 137(5) of the Firearms and Control Act 60 of 2000 (Act). The Minister then published Guidelines in the Government Gazette. However, the applicant was not satisfied with the Guidelines. The High Court dismissed a challenge by the applicant to the Guidelines. The Supreme Court of Appeal dismissed an appeal to it with costs. The Constitutional Court dismissed the application for leave to appeal against the adverse costs order on the ground that the challenge to the Guidelines was not based on any infringement of a fundamental right in the Constitution.
