Synopsis:
An application to declare unconstitutional and invalid the Constitution Thirteenth Amendment Act of 2007 and the Cross-Boundary Municipalities Laws Repeal and Related Matters Amendment Act of 2007 in so far as the Acts sought to relocate the Matatiele Municipality, formerly in KwaZulu-Natal, into the Eastern Cape in a manner which was both irrational and which failed to provide for public participation in the legislative process. The Court held that the Acts had been passed in accordance with the Constitution and dismissed the application. Judgment: Nkabinde (unanimous).
