Synopsis:
Urgent application seeking an extension of the period of suspension of a declaration of constitutional invalidity and reading-in, due to Parliament’s failure to act within the time limit stipulated in an order of the Court given on 7 March 2013 in Ngewu and Another v Post Office Retirement Fund and Others [2013] ZACC 4. The Court held that the Minister did not give an adequate explanation for the delay. The Court held that the first respondent would suffer as a result of an extension. In addition, the Minister’s predecessor had consented to the order of 7 March 2013. The Court dismissed the application for extension with costs.
