Previously, in AllPay 1 (AllPay Consolidated Investment Holdings (Pty) Ltd v Chief Executive Officer of the South African Social Security Agency [2013] ZACC 42), the Court declared the award of a tender by the South African Social Security Agency (SASSA) to Cash Paymaster Services (Pty) Ltd (Cash Paymaster) invalid for procedural irregularity. Later, in AllPay 2 (AllPay Consolidated Investment Holdings (Pty) Ltd v Chief Executive Officer of the South African Social Security Agency [2014] ZACC 12), the Court declared the contract for the payment of social grants between SASSA and Cash Paymaster invalid and ordered the tender process to be re-run. The declaration of invalidity was suspended to allow SASSA an opportunity to re-run and decide, under the supervision of the Court, on whether to award a new contract. In this case SASSA issued a new Request for Proposals (RFP) in respect of the invalidated tender. Cash Paymaster requested the Court to declare the RFP invalid for non-compliance with AllPay 2 and for being incompatible with the social grants distribution system. At the hearing, a draft order – which set out a timetable the parties agreed for completing the new tender process – was presented. The Court added an additional paragraph providing that the parties could approach the Court for further relief, thus reaffirming the Court’s supervisory jurisdiction of its order in AllPay 2.
