| dc.concourt.synopsis | Appeal concerning regulation 2(1)(c) of the regulations under the Road Accident Fund Act. The regulation allows 14 days within which an affidavit which sets out the details of the accident, must be submitted to the police or else the claimant loses the claim. Kondile AJ, writing for the majority, held that the 14-day period is too short and does not amount to a 'real and fair' opportunity to exercise the right of access to courts protected in section 34 of the Constitution. This regulation was declared invalid. |
