Synopsis:
Application for 'conditional' leave to appeal to this Court against an order dismissing their objection to indictment in terms of s 319 of the Criminal Procedure Act 51 of 1977. They also made application to the Supreme Court of Appeal (SCA) for leave to appeal and fear that their appeal may not be considered on the merits. Application for leave to appeal not conditional upon application to the SCA being refused but on a refusal by the SCA to consider appeal on its merits.
