The DP applied for leave to appeal against the judgment of the full bench of the Transvaal High Court, which dismissed the application with costs. Goldstone J, on behalf of the majority, affirmed the finding of Yacoob J in the NP case. He also found that it had not been proved that the provision violated equality rights. O'Regan J dissented on the grounds stated in the NNP case (NNP v Government of RSA and Others 1999 (3) SA 191 (CC)). | |
